These Terms of Service govern the use of the website and all purchases made through the online store.

“Customer” means any person or organisation placing an order.

“Consumer” means a natural person acting for purposes outside their trade, business, craft or profession.

Mandatory consumer rights provided by applicable law always take priority over any conflicting provision of these Terms.


2. PRODUCTS AND INTENDED USE

SkyDefender Simulations designs and manufactures handmade flight-simulation hardware, including USB controller panels, cockpit panels, display modules and related accessories.

The products are intended exclusively for flight simulation, gaming and entertainment. They are not certified aviation equipment and must not be installed in, connected to or used for the operation of real aircraft.

The essential characteristics, included components, available variants, compatibility requirements and current price of each product are shown on the relevant product page.

Because the products are handmade, minor cosmetic variations may occur between individual units. Such variations do not affect the advertised functionality or conformity of the product.

Product photographs are illustrative. Screen settings, lighting and manufacturing variations may cause minor differences in colour or surface appearance.


3. COMPATIBILITY AND CUSTOMER RESPONSIBILITIES

The Customer must review the compatibility information stated on the product page before ordering.

 

Unless otherwise stated, our simulator hardware may require:

- a compatible Windows computer;

- a free USB connection;

- supported simulator software;

- installation of drivers, configuration files, export scripts or supporting software;

- manual control assignment within the simulator.


The Customer is responsible for following the installation and configuration instructions supplied with the product.

Compatibility is determined by the product description valid at the time of purchase. Updates to third-party software, operating systems or simulators may affect compatibility. Where legally required, we will provide the updates or corrective measures necessary to maintain conformity.


4. ORDERING PROCESS

A Customer can place an order by:

1. selecting a product and the required variant;

2. adding the product to the shopping cart;

3. reviewing and correcting the cart contents;

4. entering the billing, delivery and contact information;

5. selecting the available delivery and payment method;

6. reviewing the complete order, including the total price;

7. accepting the applicable terms and policies; and

8. submitting the order using the payment-obligation order button.


Before submitting the order, the Customer can correct input errors by returning to the relevant checkout field, changing the shopping cart or using the browser navigation controls.

The Customer is responsible for checking that all selected variants, quantities, addresses and contact details are correct before submitting the order.

If an error is discovered after the order has been submitted, the Customer should contact us immediately at skydefsim@gmail.com. Changes cannot be guaranteed once production or dispatch has started.


5. CONTRACT FORMATION

The presentation of products on the website constitutes an invitation to place an order and not a binding offer by SkyDefender Simulations.

By submitting an order, the Customer makes a binding offer to purchase the selected products.

We acknowledge receipt of the order electronically without undue delay. The sales contract is concluded when we send an email clearly confirming acceptance of the order.

If the Customer does not receive electronic confirmation within 48 hours after submitting the order, the Customer is no longer bound by the order.


We may reject or cancel an order before dispatch where there is a genuine reason, including:

- an obvious pricing or product-description error;

- unavailability of essential components;

- an unsupported delivery address;

- unsuccessful or reversed payment;

- suspected fraud or misuse;

- inability to manufacture the selected configuration safely or correctly.


Where a paid order is rejected or cancelled by us, the amount received will be refunded without undue delay.


6. CONTRACT LANGUAGE AND RECORDS

The language of contracts concluded through the English-language store is English.

The electronically concluded contract is not separately filed as a signed written contract. Order details and confirmations are stored electronically in accordance with applicable legal and accounting requirements.

The Customer receives the essential order details by email and may also access them through the customer account where that function is available.

These Terms can be saved or printed using the Customer’s browser.

SkyDefender Simulations is not subject to a separate voluntary code of conduct.


7. PRICES, TAXES AND PAYMENT

The price payable is the price displayed at checkout when the order is submitted.

The checkout shows the product price, available delivery charges, discounts and other amounts collected by us.

Payment must be completed using one of the payment methods available at checkout. Payment processing may be performed by Shopify Payments, PayPal or another identified payment provider.

For deliveries outside the European Union, the destination country may impose import VAT, customs duties, brokerage fees or other charges. Unless expressly collected at checkout, these charges are not included in our price and are payable by the recipient.

Currency conversions displayed by payment providers or card issuers may include their own exchange rates or fees.


8. MADE-TO-ORDER PRODUCTION

Most SkyDefender Simulations products are manufactured or assembled after the order is placed.

The current production or processing period is displayed on the product page or during checkout. The production period begins after successful payment and after all information required for production has been received.

A change requested by the Customer after ordering may extend the production period.

The production period and carrier transit period are separate. Carrier delivery dates are estimates unless expressly identified as guaranteed.

If a material delay occurs, we will inform the Customer and provide the options required by applicable law.

A product does not become a personalised product merely because it is assembled after ordering from standard catalogue variants.

A product is treated as customised or personalised only where it is manufactured according to the Customer’s individual specifications or clearly adapted to the Customer’s personal requirements. Examples may include custom dimensions, non-standard inscriptions, individually requested layouts, special firmware or other modifications not offered as a standard catalogue variant.


9. DELIVERY

Products are delivered to the address entered during checkout.

The Customer must provide a complete and accurate delivery address and must ensure that the parcel can be received.

Tracking information will be provided where available.

For Consumer orders, the risk of accidental loss or damage remains with SkyDefender Simulations until the Consumer or a third party designated by the Consumer physically receives the product. This does not apply where the Consumer independently contracts a carrier not offered by us.

If a parcel is returned because of an incorrect address, refusal, failure to collect or another circumstance attributable to the Customer, we may charge the actual reasonable cost of reshipping, where permitted by law.

Refusing or failing to collect a parcel does not by itself constitute a valid withdrawal from the contract. The Customer must communicate the decision to withdraw clearly.


10. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS

Withdrawal, return, cancellation and refund conditions are described in our Refund Policy, which forms part of these Terms.

Nothing in these Terms limits a Consumer’s mandatory statutory withdrawal rights.

The statutory withdrawal exception for customised or clearly personalised goods applies only where the product was genuinely manufactured according to the Customer’s individual specifications or clearly personalised, and the Customer was informed of the exception before placing the order.


11. DEFECTIVE OR NON-CONFORMING PRODUCTS

Consumers retain all statutory rights relating to defective, damaged or non-conforming products.

Where a product is defective or does not conform to the contract, the Consumer may be entitled to repair or replacement without charge. Where repair or replacement is impossible, disproportionate, not completed within a reasonable period or would cause significant inconvenience, the Consumer may be entitled to an appropriate price reduction or termination of the contract in accordance with applicable law.

EU Consumers have at least the legal guarantee period required by applicable EU and national law.

Where Hungarian mandatory guarantee rules apply to the relevant product category and price, SkyDefender Simulations provides the mandatory guarantee for the statutory period.

Any additional commercial warranty applies only where its duration, scope and conditions are expressly stated on the product page or in a separate warranty statement. A commercial warranty does not replace or restrict statutory rights.

Damage caused by misuse, incorrect wiring, unauthorised modification, external power sources, liquid damage, impact damage or installation contrary to the supplied instructions is not considered an original conformity defect, unless the damage resulted from inadequate instructions or another matter for which we are legally responsible.


12. TRANSPORT DAMAGE

Customers should inspect the parcel and product after delivery.

Visible transport damage, missing items or an incorrect product should be reported as soon as reasonably possible to skydefsim@gmail.com. Photographs of the parcel, shipping label, packaging and product may help us investigate the claim.

Failure to report transport damage immediately does not remove any mandatory statutory rights.

Where the product was damaged during delivery before risk passed to the Customer, we will provide the remedy required by applicable law.


13. SOFTWARE AND DOCUMENTATION

Software, firmware, scripts and documentation supplied by SkyDefender Simulations may be used with compatible SkyDefender Simulations products for personal or internal business use.

Unless otherwise stated, the Customer receives a non-exclusive, non-transferable licence to use the supplied software with the relevant product.

The Customer may not commercially redistribute, sell, sublicense or present the software as their own.

Restrictions do not apply where mandatory law expressly permits an activity, including legally protected interoperability or backup rights.

Third-party software, simulator names and trademarks remain the property of their respective owners.


14. INTELLECTUAL PROPERTY

Unless otherwise stated, the website content, photographs, product designs, panel artwork, documentation, software, branding and original written materials are owned by or licensed to SkyDefender Simulations.

Website content may not be reproduced, distributed, commercially exploited or used to manufacture competing products without prior written permission, except where mandatory law permits otherwise.

SkyDefender Simulations is an independent manufacturer and is not affiliated with, endorsed by or sponsored by Eagle Dynamics, Heatblur Simulations or any aircraft manufacturer or trademark owner referenced on the website.


15. WEBSITE USE

The Customer must not:

- use the website for unlawful or fraudulent purposes;

- interfere with the operation or security of the website;

- submit malicious code;

- attempt unauthorised access to systems or customer data;

- misuse payment, review or customer-account functions;

- copy or scrape protected content for commercial exploitation.


We may restrict access where reasonably necessary to protect the website, customers, payment systems or our legal rights.


16. LIABILITY

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for:

- death or personal injury caused by negligence;

- intentional misconduct or gross negligence;

- mandatory product liability;

- fraud;

- breach of mandatory consumer rights.


For Consumers, our liability is governed by applicable mandatory consumer and civil law.

For business Customers, to the maximum extent permitted by law, SkyDefender Simulations is not liable for indirect or consequential business losses, loss of profit, loss of revenue, loss of data or loss arising from unsupported third-party software.

Products must not be used in real aircraft or safety-critical systems.


17. FORCE MAJEURE

We are not liable for delay or failure caused by circumstances outside our reasonable control, including natural disasters, war, governmental restrictions, industrial action, major carrier disruption, customs restrictions, widespread service outages or unexpected interruption in the supply of essential components.

This clause does not remove any right a Consumer has under mandatory law where performance is materially delayed or becomes impossible.

We will investigate written Consumer complaints and provide a substantive written response within 30 days of receipt.

If a complaint is rejected, the response will explain the reason and provide information about the available dispute-resolution options.


19. ALTERNATIVE DISPUTE RESOLUTION

Customers are encouraged to contact us directly before starting an external dispute-resolution procedure.

A Consumer may also be entitled to contact the conciliation or alternative dispute-resolution body competent according to the Consumer’s residence.

SkyDefender Simulations cooperates with conciliation procedures where required by law.

The former European Online Dispute Resolution platform was discontinued on 20 July 2025.


20. GOVERNING LAW

These Terms and the contracts concluded through the store are governed by Hungarian law.

For Consumers, this choice of law does not deprive the Consumer of mandatory protection provided by the law of the country in which the Consumer has their habitual residence.

Nothing in these Terms restricts a Consumer’s right to bring proceedings before a court competent under mandatory consumer-protection and jurisdiction rules.


21. CHANGES TO THESE TERMS

The Terms applicable to an order are the version in force when the order is submitted.

We may update these Terms for future orders where necessary because of legal, operational or technical changes. Updates do not retroactively alter an existing contract unless required by law or expressly agreed with the Customer.


22. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain effective. The invalid provision will be applied only to the maximum extent permitted by law.
